LOS ANGELES (AP) — A lawyer entered a no contest plea Wednesday for Lindsay Lohan in the theft of a necklace, setting the stage for a summer of confinement, counseling and community service.

Defense attorney Shawn Holley made the plea for the actress, who did not appear in court in the misdemeanor case involving a $2,500 necklace taken from an upscale shop in the Venice area of Los Angeles.

Lohan, 24, did not acknowledge guilt through the plea, but the court will log the case as a conviction.

She said later in the day in a written statement that she was glad to put the case behind her and has already started her 300 hours of community service at a shelter for women.

A number of attractive legends surround its origin. A wide-spread (though biologically impossible) belief is that it originated from matings between semi-wild, domestic cats and raccoons. This myth, bolstered by the bushy tail and the most common coloring (a raccoon-like brown tabby) led to the adoption of the name 'Maine Coon.' (Originally, only brown tabbies were called 'Maine Coon Cats;' cats of other colors were referred to as 'Maine Shags.') Another popular theory is that the Maine sprang from the six pet cats which Marie Antoinette sent to Wiscasset, Maine when she was planning to escape from France during the French Revolution. Most breeders today believe that the breed originated in matings between pre-existing shorthaired domestic cats and overseas longhairs (perhaps Angora types introduced by New England seamen, or longhairs brought to America by the Vikings).

People outside the alternative health community are often confused by the lack of autism in the Amish people. The Amish do not experience autism, or any of the other learning disabilities that plague our technological society. The Amish live in a society that consists of outdated technologies and ideals, by contemporary standards. Their diet consists of eating organic, fresh, locally-grown produce, and of course, they do not follow the established vaccination routines. To the dismay of the mainstream media and the medical establishment, this has resulted in a healthier people, that are void of all chronic diseases. Heart disease, cancer, and diabetes are virtually non-existent in Amish villages. Equally non-existent are modern, chemically-engineered medicines, enhanced (chemically-engineered) foods, G.M.O. foods, and of course, vaccines. How is it that those who are without the "miracles" of modern orthodox medicine are so extremely healthier? The truth about health, medicine, and how they both relate to the Amish is becoming an embarrassment to some rather powerful people.

There have been 3 (yes three) known cases of autism in the Amish, and at least two of those children were vaccinated. No information is available for the third. The strong correlation between vaccinations and autism is absolutely undeniable, unless you work for the medical establishment, the government, or Big Media. Proponents of the status-quo claim that the Amish obviously have a special super gene that makes them immune to autism. They pathetically try to rationalize that autism is some type genetic failure (i.e. God's fault), which attacks a brain based on religious affiliation. We're tentatively expecting a space alien theory next, in a similar vein to the aliens theory used to attack those who believe in a Creator. It truly is F.D.A. and A.M.A. science in all its shining glory. Vaccine proponents are willing to espouse any ridiculous explanation, so long as they do not have to accept that their entire industry of vaccinations is causing chronic disease, leaving autism for 1 in every 100 children now.

Mistletoe was used by Druid priests 200 years before the birth of Christ in their winter celebrations. They revered the plant since it had no roots yet remained green during the cold months of winter.

The ancient Celtics believed mistletoe to have magical healing powers and used it as an antidote for poison, infertility, and to ward of evil spirits. The plant was also seen as a symbol of peace, and it is said that among Romans, enemies who met under mistletoe would lay down their weapons and embrace.

Scandanavians associated the plant with Frigga, their goddess of love, and it may be from this that we derive the custom of kissing under the mistletoe. Those who kissed under the mistletoe had the promise of happiness and good luck in the following year.

There are two types of mistletoe. The mistletoe that is commonly used as a Christmas decoration (Phoradendron flavescens) is native to North America and grows as a parasite on trees from New Jersey to Florida. The other type of mistletoe,Viscum album, is of European origin. The Greeks and earlier peoples thought that it had mystical powers and down through the centuries it became associated with many folklore customs.

The European mistletoe is a green shrub with small, yellow flowers and white, sticky berries which are considered poisonous. It commonly seen on apple but only rarely on oak trees. The rarer oak mistletoe was greatly venerated by the ancient Celts and Germans and used as a ceremonial plant by early Europeans.

Origins of its name - The common name of the plant is derived from the ancient belief that mistletoe was propagated from bird droppings. This belief was related to the then-accepted principle that life could spring spontaneously from dung. It was observed in ancient times that mistletoe would often appear on a branch or twig where birds had left droppings. "Mistel" is the Anglo-Saxon word for "dung," and "tan" is the word for "twig". So, mistletoe means "dung-on-a-twig".

The Legend :

For its supposedly mystical power mistletoe has long been at the center of many folklore. One is associated with the Goddess Frigga. The story goes that Mistletoe was the sacred plant of Frigga, goddess of love and the mother of Balder, the god of the summer sun. Balder had a dream of death which greatly alarmed his mother, for should he die, all life on earth would end. In an attempt to keep this from happening, Frigga went at once to air, fire, water, earth, and every animal and plant seeking a promise that no harm would come to her son. Balder now could not be hurt by anything on earth or under the earth. But Balder had one enemy, Loki, god of evil and he knew of one plant that Frigga had overlooked in her quest to keep her son safe. It grew neither on the earth nor under the earth, but on apple and oak trees. It was lowly mistletoe. So Loki made an arrow tip of the mistletoe, gave to the blind god of winter, Hoder, who shot it , striking Balder dead. The sky paled and all things in earth and heaven wept for the sun god. For three days each element tried to bring Balder back to life. He was finally restored by Frigga, the goddess and his mother. It is said the tears she shed for her son turned into the pearly white berries on the mistletoe plant and in her joy Frigga kissed everyone who passed beneath the tree on which it grew. The story ends with a decree that who should ever stand under the humble mistletoe, no harm should befall them, only a kiss, a token of love. What could be more natural than to translate the spirit of this old myth into a Christian way of thinking and accept the mistletoe as the emblem of that Love which conquers Death? Its medicinal properties, whether real or imaginary, make it a just emblematic of that Tree of Life, the leaves of which are for the healing of the nations thus paralleling it to the Virgin Birth of Christ.

Oh, the hens started to lay so i really need to get laying cages from McMurray Hatchery seeing I'll not be able to collect eggs in the mornings Mon-Fri being I have to work. Maybe someday I'll build or buy one of these type of chicken coops.

Jai alai is "the fastest sport in the world" that uses a ball. I just finished watching a episode of Miami Vice on Hulu and in the closeing of each episode you see a quick clip of the game.

Jai-alai is a ball game that originated in Spain’s Basque region and is played in a three-walled court with a hard rubber ball that is caught and thrown with a cesta, a long, curved wicker scoop strapped to one arm.

The game is called pelota vasca in Spain but the Western Hemisphere name of Jai-alai, which is Basque for "merry festival", was given when it was introduced in Cuba. This was due to the fact that this game was played at festivals or fiestas in Spain's Pyrenees Mountains for hundreds of years. The game was then played in the open air with the walls of churches being used to bounce the ball on.

Jai-alai is characterized by its fast playing pace, in which a 125g ball (or pelota) covered with parchment skin can travel faster than 180 mph. The ball is volleyed by players wearing a wicker basket glove approximately 63 to 70 cm long. The glove, called cesta-punta in Spanish and xistera in Basque, was invented by the French Basque Gantchiqui Diturbide (also Gantxiki Iturbide) in the 19th century.

The game of Jai-alai is popular in countries like Spain and Mexico where, in some regions, the game is played in almost every town and city. Jai-alai also spread out to such countries as mainland Brazil, the Philippines, Italy, Indonesia, China and Egypt.

In the United States, Jai-alai is quite popular among gamblers in Florida where it is used as a basis for pari-mutuel gambling. In fact, professional Jai-alai in America originated at the Miami Fronton. World Jai-alai, which is based in Miami, has promoted the most extensive amateur Jai-alai program ever, with a number of schools in Spain, France and one in Miami, Florida.

SAN JOSE, California - Twitter's been having a rough couple of weeks.

A researcher looking into the attacks that knocked Twitter offline last week discovered another, unrelated security problem.

At least one criminal was using a Twitter account to control a network of a couple hundred infected personal computers, mostly in Brazil. Networks of infected PCs are referred to as "botnets" and are responsible for so much of the mayhem online, from identity theft to spamming to the types of attacks that crippled Twitter.

The dreaded Dumprep.exe, what is Dumprep.exe? Well if you use Windows XP its a Microsoft tool called “Windows Error Dump Reporting”. Basically if some file crashes on your system Windows “phones home” via Dumprep.exe and sends a error report back to the mothership where it will deleted and never looked at. The funny thing is that the dumprep.exe isn’t the most reliable program ever and can make a already bad situation worse. So let’s get rid of the narky ET.

Disable Dumprep.exe on Windows XP:
1. Right click on “My Computer” choose “Properties” from that menu.
2. Click on “Advanced tab”.
3. Click the “Error Reporting” button.
4. Check the “Disable error reporting” box.

You may choose to uncheck the the box below it, “But notify me when an error occurs” if you want.

NEW YORK - The outage that knocked Twitter offline for hours was traced to an attack on a lone blogger in the former Soviet republic of Georgia - but the collateral damage that left millions around the world tweetless showed just how much havoc an isolated cyberdispute can cause.

"It told us how quickly many people really took Twitter into their hearts," Robert Thompson, director of the Center for the Study of Popular Television at Syracuse University, said Friday.

Tens of millions of people have come to rely on social media to express their innermost thoughts and to keep up with world news and celebrity gossip.

Twitter "is one of those little amusements that infiltrated the mass behavior in some significant ways, so that when it went away, a lot of people really noticed it and missed it."

The attacks Thursday also slowed down Facebook and caused problems for the online diary site LiveJournal. But Twitter, the 140-character-or-less messaging site used by celebrities, businesses and even Iranian protesters, suffered a total outage that lasted several hours.

Those attacks continued Friday from thousands of computers pummeling its servers, said Kazuhiro Gomi, chief technology officer for NTT America Enterprise Hosting Services, which hosts Twitter's service.

Twitter crashed because of a denial-of-service attack, in which hackers command scores of computers toward a single site at the same time to prevent legitimate traffic from getting through. The attack was targeted at a blogger who goes by "Cyxymu" - Cyrillic spelling of Sukhumi, a city in the breakaway territory of Abkhazia in Georgia - on several Web sites, including Twitter, Facebook and LiveJournal.

3/4 cup ground Colombian Coffee

4 1/2 cups cold water

The Pirate Bay Trial Begins

We have all heard of the Pirate Bay, the bit torrent search engine site. It was sued by some biggies of the MPAA like MGM Pictures and Sony BMG, and the case began its trial yesterday in the Stockholm district court.

A police investigation took place way back in 2006 and the current trial is considered a consequence. The trial is being closely observed by the world because its judgment has the power to determine the future of the Internet regarding copyright infringement laws and rethink where cyber law stands.

The Pirate Bay is a Swedish site that facilitates users by providing links to torrents. It is considered the world’s largest bit torrent tracker and with an Alexa Rank of 109, I can now imagine how popular the site has become.

The Pirate Bay has millions of supporters and I am not one among them. I respect, encourage and support open source, but I have no delusions that those who take part in copyright infringement are being Robin Hood -ish. Music, movie, publishing and software industries are largely impacted by piracy and I can feel the pain when someone takes my content without my consent.

WASHINGTON - He won the fight to keep it. Now, Barack Obama is putting his beloved BlackBerry to work. Upon returning to the White House on Thursday morning after a trip to his younger daughter's school for a class presentation, the president walked along the West Wing Colonnade toward the Oval Office while looking down at the electronic communicating device he held in both hands.

White House press secretary Robert Gibbs said last week that a compromise had been reached to allow the president to use the BlackBerry to keep in touch with senior staff and some personal friends. He did not say with whom the compromise had been struck.

Gibbs said Obama will limit its use, and that security has been enhanced to protect his communications.

Previous presidents chose not to use e-mail because it can be subpoenaed by Congress and the courts, and may be subject to public records laws.

Gibbs said the presumption from the White House counsel's office is that the e-mails will be subject to the Presidential Records Act, which requires the National Archives to preserve presidential records. But he also said some exemptions in the law allow for "strictly personal communications." He did not say how that classification would be determined, but made clear that the device could be used for both business and personal exchanges.

Obama's BlackBerry has been a constant companion, and he had noted publicly that he was negotiating to find a way to keep it despite security concerns and records-keeping issues.

Gibbs said that Obama believes using the device will help him escape the "bubble" that surrounds the president.

I’m amazed and how people still don’t know how to send email. I can see why so many of us get hammered with spam, it like your best friend is selling your address. I think 90% or higher of the email one gets is just stuff forwarded but No one cleans up or knows how to send or forward email with out spreading and adding to that ever growing list of addresses.

Here is what I do and use to help in not passing addresses of people and friends plus most would like to have some control over who see or get our address. The first thing is Always post any and all addresses in the BBC line of your email. Bcc Means Privacy and Efficiency and Fortunately, you don't have to send individual emails to avoid this embarrassing exposure of email addresses. In addition to To: and Cc: recipients that show up in the e-mail’s headers, you can insert Bcc: recipients.

Bcc:

A Bcc (blind carbon copy) is a copy of an email message sent to a recipient whose email address does not appear in the message. This is in contrast to To and Cc recipients, whose addresses do appear in the respective header lines. Every recipient of the message can see all the To: and Cc: recipients, but doesn’t see the Bcc: recipients.

"Undisclosed Recipients"

Insert "Undisclosed Recipients" in the To: field, followed by your email address in "<,>" braces. • The To: field should look like: "Undisclosed Recipients ".

If you send emails to undisclosed recipients frequently, you can add your own email address to your address book with "Undisclosed" as the first and "recipients" as the last name. Instead of filling in the To: field manually, you can then use the address book entry.

Put all the recipients' email addresses in the Bcc: field, separated by commas.
The Bcc: field could look something like: "my.first.friend@example.net, my_second_friend@example.net, stillanotherfriend@example.com".

In another nod to his alleged "free-market" principles, President Bush has expressed disapproval of the free nationwide Wi-Fi proposal being considered by the FCC and Congress.

It's an inauspicious time to decry helpful, even vital democratic initiatives in favor of ideology -- after all, many of our most outspoken critics of federal mandate and regulation have ended up looking dogmatic, shortsighted or downright ignorant of late.

But that hasn't stopped the Bush team from making its anti-populist agenda known. Commerce Secretary Carlos Gutierrez issued an open letter to the FCC this week, stating the administration's argument against legislation that could lead to nationwide no-fee wireless Internet. The administration hopes to influence FCC Chairman Kevin Martin to overturn the proposal during the FCC's next scheduled meeting on December 18th.

The legislation, which is before Congress now, would require whoever buys the chunk of wireless spectrum being auctioned next year to set aside a quarter for no-fee service to rural areas that don't have broadband access.

During most of my running clinics, the subject of caffeine is frequently raised. "Is there any benefit from taking coffee before a race?" someone will ask. My answer has always been: "It gets me to the line."

I have never been a scientist about caffeine. I have ignored the evidence pro and con. Drinking coffee or some other caffeine-containing drink has always been the way I jump start my engine in the morning. Life does not get under way until my first cup of coffee in the morning.

On race day, my standard operating procedure is coffee on arising, followed by a diet cola on the drive to the race. Runners have been described as people with energy, dedication and discipline. I like to think I share in those qualities - but not before my cup of coffee. Coffee takes me out of my drowsy half-awakened state and transforms me into a person eager to get on with the heroic quest.

Coffee lovers are familiar with these matutinal effects. And that first cup drunk, the world is ready to be conquered and I am equal to the task.

These psychological effects of caffeine cannot be denied. It does away with what the psychologists call "task aversion." I am no longer thinking of reasons not to run this race. I am willing and wanting to join my friends at the starting line of this agony-to-be.

Sen. Barack Obama of Illinois claimed the Democratic presidential nomination Tuesday night, NBC News projected based on its tally of convention delegates. By doing so, he shattered a barrier more than two centuries old to become the first black candidate ever nominated by a major political party for the nation’s highest office.
“Tonight, I can stand before you and say that I will be the Democratic nominee for president of the United States,” Obama planned to say in a victory celebration in St. Paul, Minn., at the site of the convention that will nominate his Republican opponent in the fall, Sen. John McCain of Arizona.
Obama’s victory would come on the final day of the Democratic campaign schedule, as voters in South Dakota and Montana voted in the final primaries. But it was the decisions of the last unpledged party officials, known as superdelegates, who would put Obama over the top.

Throughout the day, as Obama edged closer to the number of 2,118 delegates needed to win the nomination, more and more superdelegates relentlessly ticked over into his column, leading him to claim victory early in the evening.
Other notable black candidates have run for president, but it was Obama who broke through to be embraced by one of the two major parties, 45 years after Martin Luther King Jr. declared his dream for a colorblind America.
In a speech Tuesday night in New Orleans, McCain welcomed Obama to the general election campaign as a “formidable” opponent. But he proclaimed that he was “ready for the challenge and determined to run this race in a way that does credit to our campaign and to the proud, decent and patriotic people I ask to lead.”
Obama kills off challenge from ClintonNBC News projected Obama as the presumptive Democratic nominee at 9 p.m. ET, as polls closed in South Dakota. It said the primary was too early to call, but it said Obama would win at least six delegates. Combined with late superdelegate declarations, it said Obama had gone over the 2,118 delegates he needed.
Obama, 46, of Illinois, bested Sen. Hillary Rodham Clinton of New York in a historic campaign that sparked record turnouts in primary after primary, yet exposed deep racial and gender divisions within the party.
Throughout the day, as superdelegates fell into Obama’s column, speculation increased that McCain could be facing an Obama-Clinton unity ticket.

You are about to discover something that scared the hell out of me. The locks I rely on to protect my family and my business can be opened without damage in seconds. By just about anyone, using easily found information about Bump Keys.

You don't need special tools. Or locksmith training. All you need is a normal key that you can file down with an ordinary file. Or you can buy a bump key on the internet.

Firstly - my philosophy. I don't believe in "Security by Obscurity" - where severe problems with the things that we rely on are covered up and kept secret for use by people who want to harm us. The technique of bump keying (also known as rapping) has been known for over 50 years. Lock manufacturers and criminals know all about it. While all of us poor suckers still buy crappy locks that we falsely believe will protect our families and possessions.

What 's the Problem?

There is a fundamental flaw in the design of the pin and tumbler mechanisms that are used on commonly sold latches and deadlocks. Including those rated as "high security". This flaw makes it possible for anyone to open many of these locks - even deadlocks - very quickly using a technique known as "bumping" This technique does not damage the lock. All you need is a filed down key that fits into the lock, and some practice using a certain technique,

In a bizarre twist, the more expensive locks are actually easier to open, because of their tighter tolerances, and better quality. A Dutch consumer organisation tested over 60 locks that have been approved by the police as providing High Security, and found that most of them could be bumped open.

I realise that locksmiths and criminals have always been able to open locks without keys. But this technique allows almost anyone to do it. At first, I thought Bump Keying was a joke, so I spent a large part of a weekend researching it. Unfortunately I found that the technique actually works.

Imagine This. You arrive home (or at your business), unlock the door, and discover that everything of value is missing. Your new Home Entertainment system, Computers, Stereo Equipment, etc. etc. All gone. You are devastated. But that 's nothing to what happens next. You call the police and your insurance company, and make a claim. The insurance company refuses to pay.

What 's worse - they think you did it - because there is no sign of illegal entry, and your premises are protected by high quality locks. They might even charge you with attempted fraud. Not a nice situation for an innocent, recently burgled person to find themselves in.

This situation is apparently becoming more and more common. In Australia some companies will pay out on a theft claim where there is no forced entry, as long as the theft has been reported to the police. Some won't. (Check your situation with your insurer.) And even if your premises are not burgled, are you comfortable with the fact that someone can open your locks, come in and snoop around your house, and then leave without a trace? Bump Keys make this possible.
Bump Keying - The Proof.
NOVA is a well respected European TV program. They have made a video, which includes a full demonstration of key bumping, and comments from lock experts and police. You can find the link from the resource box below. Like I said, it scared the hell out of me - especially after I tried an experiment myself, and found that everything I had discovered was true.

I obtained a bump key, and practiced on the deadlock on my back door for about 5 minutes. After about 15 tries, I got the technique right, and the lock opened. Another 10 tries - did it again. Another 5 minutes, and I could do it almost every time. I tried another lock at home - and it opened. I then went over to my sister 's house, and she was stunned when I opened her security deadlock at the second attempt. (total time taken for both attempts: - 4 seconds)

Not every lock can be bumped. I've tried 2 others without success. But experts estimate that the technique will work on the majority of commonly used house locks.

How Many People Know about This? Many Millions. There are lots of Internet sites and fully documented reports about the technique readily available on the internet. Bumping has been widely reported in Europe, and covered on several TV programs. The US magazine Newsweek also did a story on it recently, and it 's all over the social contact sites that young people use.

What To Do Next

1. If you are concerned about this, go to your locksmith and buy a bump proof lock cylinder.
I understand that Abloy disk tumbler locks, and BiLock locks cannot be opened by bumping.

2. Do some research regarding the topics discussed here.

3. Take as much (or as little) action that you feel is necessary to adequately protect your family and property.

If you have some tinfoil handy, now might be a good time to fashion a hat. At the Digital Living Room conference today, Gerard Kunkel, Comcast’s senior VP of user experience, told me the cable company is experimenting with different camera technologies built into devices so it can know who’s in your living room.

The idea being that if you turn on your cable box, it recognizes you and pulls up shows already in your profile or makes recommendations. If parents are watching TV with their children, for example, parental controls could appear to block certain content from appearing on the screen. Kunkel also said this type of monitoring is the “holy grail” because it could help serve up specifically tailored ads. Yikes.

Kunkel said the system wouldn’t be based on facial recognition, so there wouldn’t be a picture of you on file (we hope). Instead, it would distinguish between different members of your household by recognizing body forms. He stressed that the system is still in the experimental phase, that there hasn’t been consumer testing, and that any rollout “must add value” to the viewing experience beyond serving ads.

Perhaps I’ve seen Enemy of the State too many times, or perhaps I’m just naive about the depths to which Comcast currently tracks my every move. I can’t trust Comcast with BitTorrent, so why should I trust them with my must-be-kept-secret, DVR-clogging addiction to Keeping Up with the Kardashians?

Hacker Super Bowl pits Mac OS vs. Linux, Vista

Not that this would change my mind about any of the three or make me go to just using one over the other, but I found it interesting that the Mac was the first to go...

Three targets, all patched. All in typical client configurations with typical user configurations. You hack it, you get to keep it.

Each has a file on them and it contains the instructions and how to claim the prize.

Targets (typical road-warrior clients):

MacBook Air running OSX 10.5.2

This year's contest will begin on March 26th, and go during the presentation hours and breaks of the conference until March 28th. The main purpose of this contest is to present new vulnerabilities in these systems so that the affected vendor(s) can address them. Participation is open to any registered attendee of CanSecWest 2008.

Once you extract your claim ticket file from a laptop (note that doing so will involve executing code on the box, simple directory traversal style bugs are inadequate), you get to keep it. You also get to participate in 3com / Tipping Point's Zero Day Initiative, with the top award for remote, pre-auth, vulnerabilities being increased this year. Quick Overview:

-Limit one laptop per contestant.
-You can't use the same vulnerability to claim more than one box, if it is a cross-platform issue.
-Thirty minute attack slots given to contestants at each box.
-Attack slots will be scheduled at the contest start by the methods selected by the judges.
-Attacks are done via crossover cable. (attacker controls default route)
-RF attacks are done offsite by special arrangement...
-No physical access to the machines.
-Major web browsers (IE, Safari, Konqueror, Firefox), widely used and deployed plugin frameworks (AIR, Silverlight), IM clients (MSN, Adium, Skype, Pigdin, AOL, Yahoo), Mail readers (Outlook, Mail.app, Thunderbird, kmail) are all in scope.

Wal-Mart Sues Brain-Damaged Worker

Wal-Mart has spent millions trying to convince consumers that its critics are wrong about its anti-worker actions and that it is a good company that cares about its employees and the community. But the way the company has treated Deborah Shank shows the retail giant’s true colors.

The company, which earned $2.9 billion last quarter, sued a former employee who suffered permanent brain damage in a car accident to get back $470,000 it spent on her medical bills.

Here’s the story. The Wall Street Journal (subscription required) reported yesterday that Deborah Shank, 52, who stocked shelves in Wal-Mart’s store in Cape Girardieu, Mo., was broadsided by a tractor-trailer seven years ago, causing permanent brain damage. Unable to walk without help or communicate meaningfully with her family, she now lives in a nursing home.

Wal-Mart’s health insurance plan paid about $470,000 in medical expenses. But after the Shanks sued and settled with the trucking company, Wal-Mart sued the couple and demanded its money back, plus interest and legal fees—more than the $417,477 the settlement had placed in a special-needs Medicaid trust fund for Shank’s future health care expenses.

A federal judge ruled that Wal-Mart’s health care plan gave them first dibs on any money gained by an injured employee. Such provisions aren’t uncommon in health plans, and Wal-Mart isn’t the first to enforce one.

To add to the tragedy, shortly after the judge ruled against the Shanks, their son, Jeremy, was killed in Iraq. The Shanks have two other sons.

Deborah Shank, who receives Medicaid, is not the only Wal-Mart employee receiving public health care. More than 60 percent of Wal-Mart employees—600,000 people—are forced to get health insurance coverage from the government or through spouses’ plans or live without any health insurance. Last year, the AFL-CIO released a report showing how Wal-Mart shifts health care costs to consumers and a bunch of studies showing how Wal-Mart profits from taxpayers.

In the “it’s legal, but is it moral” category, Wal-Mart’s lawsuit shows its unrestrained greed. As the Los Angeles Times points out in an editorial today:

Doing what the law allows isn’t the same as doing the right thing, however. The company made itself whole at the expense of a helpless former employee who will never be whole again. Instead of having some resources to improve her care, Shank will receive only the basic services afforded her by Medicaid and Social Security. Nor will the trust fund be in a position to reimburse Medicaid (i.e., taxpayers), which stood to collect any unspent money upon Shank’s death.
Wal-Mart has spent the last few years working hard to rebut health care reformers, labor unions, anti-globalization groups and other critics who’ve argued that it puts profits ahead of humanity. While its advertising campaigns try to put a friendlier spin on the company, its behavior toward Shank tells a different story. If Wal-Mart can’t restrain itself, perhaps Congress should prevent health plans from draining settlements won by injured workers with more bills to pay.

Wal-Mart’s anti-worker actions could fill (and have filled) books.

Earlier this year, a New Jersey court ruled a class action suit could proceed on behalf of 80,000 current and former Wal-Mart employees who say they were forced to work off the clock.

Human Rights Watch issued a report showing how Wal-Mart systematically thwarts workers’ efforts to form unions. Recent reports also reveal how the retailers’ reliance on goods made by cheap labor in China threatens public safety and costs nearly 200,000 jobs.

Could and would the company you are working for do this to you? Something to think about before suing.

NJ Students Punished for Penny Payments..

READINGTON TOWNSHIP, N.J. - Sometimes a penny for your thoughts isn't a good thing. Readington Township school officials gave 29 students detention after they used pennies to pay for their $2 lunches.

Superintendent Jorden Schiff says it started out as a prank. But as the eighth-graders began to get in trouble for taking up so much time, it turned into a protest about Thursday's shortened lunch period.

Schiff said the students were punished for holding up their peers and disrespecting lunch aides.

Schiff said some parents think a two-day detention went too far and others think it wasn't enough.

The school said it wants students to know they can express themselves without disrupting other people.

Computer Memory Vulnerable to Hacking

The Princeton report shows how encryption, long considered a vital shield against hacker attacks, can be defeated by manipulating the way memory chips work. The researchers say the ease of their attack raises fears about the security of laptop computers increasingly used to store sensitive information, from personal banking data, to company trade secrets, to national security documents.

Freezing a dynamic random access memory, or DRAM, chip, the most common type of memory chip in personal computers, causes it to retain data for minutes or even hours after the machine loses power, the report found. That data includes the keys to unlock encryption. Without freezing, the chip loses its contents within seconds.

Hackers can steal information stored in memory by rebooting the compromised machine with a simple program designed to copy the memory contents - before the computer has a chance to purge sensitive data, according to the study. (More here)

In 1962, photographer Bert Stern shot a series of photos of Marilyn Monroe that have collectively come to be known as “The Last Sitting.” Taken during several boozy sessions at the Hotel Bel-Air, the photographs are arguably the most famous images ever captured of America’s most famous actress: Monroe, sleepy-eyed and naked, sips from a Champagne glass, enacts a fan dance of sorts with various diaphanous scarves, romps with erotic playfulness on a bed of white linens. Six weeks after she had posed, Monroe was found dead of an apparent barbiturate overdose.

In New York Magazine's current Spring Fashion issue, Lindsay Lohan is reborn as Marilyn Monroe, posing for photographer Bert Stern as Monroe did in 1962 for a sessions that became known as "The Last Sitting." But many of you probably knew that already. And many of you have already seen the pictures. So because the session is historic and beautiful, we're pleased to share five outtakes that did not appear in the magazine.
